0. Authentication

All authentication in this app is handled through third-party sign-in providers (such as Google Sign-In, and where supported, Sign in with Apple).

The App does not provide or support local username/password account creation. However, when you sign in, an app-level profile may be created for you so that we can store your learning progress and settings.

1. Overview

TruckTalk Pro (“the App”) is developed and maintained by Potential Development Association (“PDA”), a nonprofit educational organization. Certain training materials are provided in partnership with J&S Reliance Driving School and other industry partners.

The App is designed for educational purposes only, to help users (especially commercial drivers and CDL trainees) improve their English communication skills in real-world driving and work scenarios.

2. Disclaimer

The questions, dialogues, scenarios, explanations, and reference materials in the App are for practice and self-assessment only. They:

• Do not represent official DMV, government, or licensing exam content;

• Do not constitute legal, employment, immigration, or safety advice;

• Are intended as supplemental learning tools, not as a replacement for official training, handbooks, or professional instruction.

PDA and J&S Reliance Driving School are not liable for:

• Any exam results, licensing decisions, or employment decisions;

• Any accidents, citations, or other consequences arising from how you drive or work.

You are responsible for following all applicable laws, regulations, and employer policies.

3. Acceptance of Terms

By downloading, accessing, or using the App, you:

• Confirm that you are legally able to enter into this agreement in your jurisdiction; and

• Agree to be bound by these Terms of Use.

If you do not agree to these Terms, you must not use the App.

PDA may update these Terms from time to time. When we do, we will update the “Last updated” date above, and continued use of the App after changes means you accept the revised Terms.

4. Intellectual Property

Unless otherwise stated:

• All App content—including questions, scenarios, prompts, UI/UX design, branding, workflows, and instructional logic—is the intellectual property of PDA.

• CDL and driving-school curriculum content remains the academic property of J&S Reliance Driving School, used under partnership agreements.

You may not:

• Copy, record, scrape, or redistribute App content for commercial use;

• Reverse-engineer, decompile, or attempt to extract question banks, datasets, or internal logic;

• Use the App to build a competing product without prior written permission from PDA.

PDA grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your own personal study and practice only.

5. Pricing, Trials, and Payments

5.1 Free access

New users may receive free access or a trial (for example, a limited number of lessons, quizzes, or practice sessions). PDA may change the structure or duration of free access at any time.

5.2 Paid access and subscriptions

After the free trial, some features (such as full course access, advanced practice, or extra content) may require a paid upgrade or subscription.

• Purchases and subscriptions are processed through the relevant app store or payment provider (for example, the Apple App Store or Google Play Store).

• Pricing, available plans, and promotions may change from time to time.

• Where we offer auto-renewable subscriptions, the subscription:

  • Has a clearly stated title (for example, “TruckTalk Pro Monthly”);

  • Runs for a stated period (for example, one month) and renews automatically at the same price and period until canceled;

  • Can be managed or canceled in your App Store account settings at any time.

The App and its purchase screens will show the subscription title, duration, price (and price per period where appropriate), and links to our Privacy Policy and Terms of Use as required by the app store.

5.3 Refunds

Unless required by applicable law or by the app store’s refund policies, all payments are final and non-refundable. Any refunds, if granted, are handled through the app store you purchased from, not directly by PDA.

6. Screenshot and Anti-Abuse Rules

To protect educational content and partner materials, PDA may implement screenshot detection and anti-abuse mechanisms. By using the App, you agree that:

• Content is for your personal study only.

• Automated scraping, large-scale screen recording, or other bulk copying is strictly prohibited.

If we detect repeated or suspicious activity (such as excessive screenshots or recording aimed at copying content), we may:

• Temporarily suspend your in-app access;

• Limit certain features; or

• Permanently terminate your account or access to the App.

Any enforcement actions are at PDA’s reasonable discretion. No refunds will be provided for periods during which access is restricted due to policy violations, except where required by law.

7. Usage Rules and Prohibited Conduct

You agree not to:

• Use the App for any illegal, harmful, or fraudulent purpose;

• Harass, threaten, or abuse any other person through the App (including support channels);

• Attempt to circumvent technical protections (such as rate limits, screenshot detection, or security measures);

• Interfere with the App’s servers, networks, or infrastructure;

• Use the App to generate or distribute hate speech, explicit content, or other harmful material.

PDA reserves the right to investigate and take appropriate action (including suspension or termination of access) if these rules are violated.

8. Language and Localization

The App currently supports 12 languages in the user interface and key learning content:

Translations are provided for convenience only. In case of inconsistency or dispute between language versions, the English version of these Terms will prevail.

9. Privacy and Data Usage (Summary)

This section is a high-level summary only. The full details are described in the PDA Privacy Policy, which is incorporated by reference into these Terms. If there is any conflict, the Privacy Policy controls.

9.1 What we may collect

Depending on how you use the App, we may collect:

• Account information from your sign-in provider (e.g., Google ID, display name, email);

• Usage data, such as the lessons you complete, quiz attempts, and in-app actions, to personalize learning and improve the App;

• Performance and diagnostic data, such as crash logs or technical logs (e.g., via Firebase);

• Where enabled by you, audio recordings of your practice sessions, for pronunciation and feedback features.

9.2 How we use data

We use this data to:

• Provide and improve App features, including tracking your progress;

• Diagnose and fix problems;

• Prevent abuse and protect the security of the App;

• Communicate important information about the App (e.g., account issues, material changes).

We do not sell personal data to third parties.

9.3 Data sharing

We may share limited data with:

• Service providers that help us operate the App (e.g., analytics, hosting, crash reporting), under appropriate data-protection agreements;

• Authorities, if required by law.

We do not share user data with advertising networks for the purpose of selling personal profiles.

9.4 Data retention and deletion

We retain data for as long as reasonably necessary to provide you with the App and to comply with legal obligations.

You may request deletion or anonymization of your personal data (including account data) by:

• Using the in-app account-deletion tools where available (see Section 15); or

• Contacting us at support@pdaus.org.

We will take reasonable steps to honor valid deletion requests, subject to legal and operational requirements (such as record-keeping obligations).

10. Advertisements and Third-Party Content

The App may display in-app advertisements, job postings, training offers, or promotions from third-party partners.

These are provided for information only. PDA:

• Does not endorse, guarantee, or verify the accuracy, quality, or safety of third-party ads or opportunities;

• Is not responsible for any transactions, communications, or relationships you enter into with third parties.

You should always independently evaluate any job offers, training providers, or advertisers before engaging with them.

11. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied.

• PDA and its partners will not be liable for any indirect, incidental, consequential, or special damages, including loss of data, profits, or opportunities, arising from your use of (or inability to use) the App.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In those cases, PDA’s liability will be limited to the minimum extent permitted by applicable law.

12. Termination

PDA may suspend or terminate your access to the App, with or without notice, if:

• You breach these Terms;

• You engage in fraud, abuse, or security violations; or

• We discontinue or substantially modify the App.

You may stop using the App at any time. Termination does not entitle you to a refund unless required by law.

13. Account Deletion

If you have created an account or profile within TruckTalk Pro (for example, by signing in with a third-party provider), you may:

• Delete your account directly from within the App, via the account or settings menu (for example, Settings → Account → Delete Account), where this feature is available; or

• Contact us at support@pdaus.org and request deletion or anonymization of your account data.

Deleting your account will normally:

• Remove or anonymize your profile and learning progress from PDA systems;

• Log you out of the App on your devices.

Account deletion does not affect your underlying third-party sign-in account (for example, your Google or Apple ID), which remains governed by that provider’s own terms and policies.

14. Governing Law

These Terms will be governed by and construed in accordance with the laws of the jurisdiction in which PDA is organized, without regard to its conflict-of-law rules, unless another jurisdiction is required by applicable consumer protection laws.
