POTENTIAL DEVELOPMENT ASSOCIATION (PDA) helps you get involved in society. The New York complicated rules on driver’s license always confuse its residents. As a new immigrant here, you might get into trouble easily if you do not take care of this matter seriously. There are some important rules regarding your driving privilege you have to know. If you plan to drive in New York City, you have to learn at least three subjects: the types of tickets, the points on your driver’s license, the required insurance attached to your vehicles. PDA have provided with the guideline here for your reference.
Yellow/ TVB Ticket (Non-Criminal Moving Ticket)
a. For most tickets when you were stopped or pulled over by the police. The results will be the fine and there also will be points incurred on your driver’s license. Be mindful of these points because it is very important. These points will be accumulated within a specific period, and it will end up that your driver’s license be suspended.
b. To dispute this type of ticket, you have to appear on a court day before Judge. These Tickets will be handled by New York State Department of Motor Vehicles (DMV) Traffic Violations Bureau (TVB). A DMV Administrative Law Judge will hear your case. The Judge has the authority to decide whether you are guilty, set fines, and take action against your license or driving privileges.
c. Methods to resolve the ticket:
(1) Plea Guity: you pay the fine and have points on your driver’s license.
(2) Plea Not guilty:
(a) Following the due date on the ticket. Plea not guilty and schedule a hearing.
(b) You or your retained attorney should appear on the court hearing to defend the traffic violation.
(c) After the hearing, Judge will find you guilty or not guilty on the argued violation. If you were found not guilty, the ticket will be dismissed with no fines or points. You will have the fine and points after a guilty judgment.
(3) If you do not plea with the required period, you will be found guilty by default.
(4) Statement in Place of Personal Appearance Form.
If you prefer not to appear in court, you could submit evidences and written statements to the court in lieu of the court appearance. This form must be received by Court at least two weeks before your hearing date. Please check the website for the process to submit this form at:
