App Terms & Privacy Policy

     This document is provided for general informational purposes only and does not constitute legal advice. For important legal matters, please consult a qualified attorney in your jurisdiction.

1. Scope of Application

This master policy applies to all digital services, mobile applications, and websites developed or maintained by Potential Development Association (“PDA”), whether released through the Apple App Store, Google Play Store, or any web-based platform.

Individual apps or services may include app-specific Terms of Use or feature descriptions, accessible via in-app links or from the “Sub-App Terms Directory” below.

If there is any conflict between this master policy and an app-specific supplement, the app-specific Terms normally govern that particular product.

2. App Usage Policy (General Terms of Use)

PDA software is developed primarily for educational and nonprofit purposes, including language learning, test preparation, and skills training.

By using PDA apps and services, you agree that you will not:

  • Reproduce, modify, screen-record, mass-screenshot, extract, scrape, or distribute any app content, materials, or design elements without explicit written permission from PDA.

  • Reverse-engineer, decompile, or attempt to extract question banks, audio, datasets, or models.

All interface designs, practice questions, teaching content, source code, audio materials, and branding elements are the exclusive intellectual property of PDA and any listed partners.

If we reasonably believe that you have violated these rules, PDA may:

  • Temporarily or permanently suspend your account;

  • Restrict access to specific apps or services; and/or

  • Pursue legal enforcement where applicable.

3. Privacy Policy – Data Collection and Use

PDA aims to collect and use only the minimum data necessary to operate and improve our educational services. We do not sell user data.

Depending on the specific app or feature, we may collect:

  • Account and login identifiers, such as Apple ID, Google account, email address, or phone number, when you sign in via third-party providers (e.g., Sign in with Apple, Google Sign-In) or other supported methods.

  • Basic profile information provided through those sign-in providers (for example, display name or language preference).

  • Usage and progress data, such as quiz attempts, scores, error logs, practice history, and in-app actions, used to provide personalized learning and track educational outcomes.

  • Diagnostic and technical information, such as crash logs, device type, OS version, and performance metrics (for example, via Firebase, Crashlytics, or similar compliant platforms).

  • For certain language or speaking products (such as TruckTalk Pro), audio recordings and speech samples that you choose to submit for practice, scoring, or feedback.

We use this data to:

  • Provide core functionality (authentication, access control, content delivery, scoring, and feedback);

  • Maintain service security, prevent abuse, and enforce usage policies;

  • Improve app quality, measure performance, and develop new features;

  • Provide user support when you contact us.

We do not share or sell user data to third parties for their own advertising or resale. We may, however, share data with:

  • Service providers and processors who help us operate the apps (e.g., hosting, analytics, push notification, payment processing), under appropriate contractual and data-protection safeguards;

  • Public authorities or legal entities when we are required to do so by law or in order to protect users, PDA, or the public.

Where cloud storage is enabled, user progress, quiz records, or app-usage data may be stored securely in Firebase / Firestore or other compliant platforms, strictly for educational progress tracking and service operation.

4. User Rights and Account Deletion

Subject to local law, users generally have the right to:

  • Access personal information held by PDA;

  • Correct inaccurate or outdated personal information;

  • Delete or anonymize personal information, where feasible;

  • Restrict or object to certain types of processing, as allowed by law.

Requests may be submitted via email or using in-app tools (where available).

  • Uninstalling an app will normally delete data stored locally on your device.

  • To request deletion or anonymization of cloud-stored records (for example, quiz history or account-linked progress), you may contact PDA using the information in Section 12.

For certain apps that support account creation (including TruckTalk Pro), you may also:

  • Initiate account deletion directly from within the app via the account or settings menu (for example, Settings → Account → Delete Account), where this feature is available.

PDA does not require or intentionally collect more personally identifiable information than is needed for login and support. Depending on the app, we may not be able to locate or delete records if you cannot provide sufficient account details (such as email address, phone number, or the third-party account used to sign in).

5. Payment & Subscription Policy

Each PDA application may include free trial sessions, subscription fees, one-time purchases, or access limitations based on that app’s educational structure.

  • Pricing, subscription durations, refund terms, and usage caps may vary per app and are detailed in each app’s app-specific Terms of Use or store listing.

  • Auto-renewable subscriptions (where offered) follow the rules and cancellation options of the relevant app store (for example, the Apple App Store or Google Play Store).

  • Unless otherwise specified in the relevant app-specific Terms or required by the app store’s policies or local law, all payments are final and non-refundable.

All purchases are processed through trusted platforms (such as the Apple App Store or Google Play Store). Billing issues are typically handled through the respective store’s support flow.

6. Institutional & Child Use

All PDA software and content are designed for users aged 16 years or older, unless a specific app clearly states a different age range.

Institutional, commercial, or enterprise-level use (e.g., by schools, employers, or training centers) requires prior written authorization from PDA.

Parents or legal guardians remain responsible for reviewing and supervising any use of PDA apps by minors and ensuring that such use complies with local laws.

7. External Links & Third-Party Sites

PDA apps and websites may contain links or references to:

  • Driving schools, training providers, or educational partners;

  • Job platforms, recruitment pages, or industry resources;

  • External documentation, official regulation sites, or reference materials.

PDA does not control and is not responsible for the accuracy, security, or content of any third-party sites.

When you choose to visit a third-party site:

  • Some limited technical data (such as your IP address) may be transmitted as part of normal web browsing;

  • PDA does not sell or share your personal profile to external advertisers from these links.

Users should independently evaluate any third-party offers, services, or websites before interacting with them.

8. Limitation of Liability & Disclaimer

All information, materials, and tools provided by PDA are for educational and informational purposes only.

PDA makes no warranties—express or implied—regarding:

  • The accuracy, completeness, timeliness, or suitability of any content;

  • The outcome of any exam, license application, training, or employment process;

  • The availability or error-free operation of our apps or services.

To the maximum extent permitted by law, PDA shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to:

  • Your use or inability to use our services;

  • Any reliance on information provided by PDA;

  • The actions, content, or services of third parties.

Users are solely responsible for complying with local laws, traffic regulations, employer policies, and licensing requirements.

9. Policy Changes & Updates

This policy may be updated or revised from time to time to reflect:

  • Changes in our services, partnerships, or technical infrastructure;

  • New legal or regulatory requirements;

  • Adjustments in our data-handling and security practices.

The latest version will always be available on our website and, where supported, within our apps.

Users are encouraged to review this policy periodically. Continued use of PDA services after any changes constitutes acceptance of the revised policy.

10. Governing Law & Language

Unless local law requires otherwise, this policy shall be governed by and construed in accordance with the laws of the United States.

In the event of any discrepancies or conflicts between different language versions, the English version shall prevail.
